How to tell whether your own product can legally be made in a home kitchen — the pH and water-activity science behind cottage-food lists, and how to classify your recipe against your state's.

By the end of this lesson you can look at your own product and put it in the
right box: the shelf-stable, low-risk foods a home kitchen is allowed to make,
or the ones that need refrigeration to stay safe and almost always mean a
commercial kitchen. The reason a cottage-food list allows jam but bans
cheesecake isn't bureaucratic whim. It's one piece of food science, and once you
can see it, you can classify your own recipe before an inspector ever does.
Why the lists allow some foods and ban others
Every state's cottage-food list is built on the same idea: a home kitchen may
make foods that stay safe sitting on a shelf, and may not make foods that grow
dangerous bacteria at room temperature. What separates the two isn't the
recipe's name — it's whether bacteria can grow in it.
Two things stop the bacteria that make people sick: acid and dryness. A food
acidic enough, or dry enough, denies pathogens the conditions they need and
stays safe on a counter for weeks or months. This is the
, and it's why breads, jams,
pickles, dry mixes, and hard candies sit on nearly every state's allowed list.
Each of those clears at least one hurdle high enough to be safe.
The two hurdles states lean on hardest are pH and water activity. Both are worth
understanding, because together they decide which side of the line your product
sits on.
The acidity hurdle: pH 4.6
pH measures how acidic a food is — the lower the number, the more acidic. The
value that matters for safety is 4.6. At or below a pH of 4.6, the bacterium
behind botulism, Clostridium botulinum, cannot grow or produce its toxin. That
single fact anchors a lot of federal food law.
The FDA's canning rules put the line in writing. Under
21 CFR 114,
an
is defined by exactly that number: a finished equilibrium pH of 4.6 or below. And
under
21 CFR 113,
the highest-risk category — "low-acid" foods, the ones that need pressure-canning
and a filed process — is defined as foods whose finished pH is above 4.6 and
whose water activity is above 0.85. Flip that definition around and you have
the safe zone: a food at or below 4.6 in pH is out of the most dangerous box.
This is why acidic foods fill cottage lists. Jams and jellies, pickles, most hot
sauces, fruit butters, and vinegar-based products are naturally or deliberately
acidic. If your product is one of these, its pH is probably doing the safety
work.
Sour to the tongue isn't the same as pH 4.6
Tasting tart tells you nothing precise. A barely-acidic tomato sauce or a
low-sugar chutney can sit above 4.6 and be unsafe on a shelf. The only way to
know is to measure the finished pH with a calibrated meter, not a guess — and
for a borderline product, to have a process authority confirm it. A later

The dryness hurdle: water activity 0.85
The second hurdle is moisture — but not moisture the way you'd weigh it. What
matters is a food's
.
Honey and a fresh apple can hold similar amounts of water by weight, yet honey's
water is bound up by sugar and unavailable, so bacteria starve.
The conservative safety line is a water activity of 0.85. The same federal
canning rule that sets the pH line uses 0.85 for moisture: a food at or below
0.85 water activity falls outside the low-acid, high-risk category, because
pathogens like Staphylococcus aureus generally can't grow or make toxin below
that point. Dry mixes, hard candies, many baked goods, dried herbs, granola,
honey, and hard grated cheeses all clear the dryness hurdle — which is why they,
too, live on cottage lists.
TCS foods: the category a home kitchen usually can't touch
Now the other side of the line. A food that clears neither hurdle — not acidic
enough, not dry enough — needs refrigeration or hot-holding to stay safe. The
industry name for it is a
,
and it's the term the FDA Food Code uses for exactly the foods most states keep
out of home kitchens.
TCS foods are where real foodborne-illness risk lives: fresh meat and poultry,
seafood, most dairy, cut melons and cut leafy greens, cooked rice and beans,
custards and cream fillings, cheesecake, soft cheeses, and cooked foods meant to
be held cold. They're banned from most cottage operations for a plain reason —
keeping them safe depends on continuous, monitored refrigeration and controls a
home kitchen isn't built or inspected for. The exemption exists for foods that
are safe without that infrastructure; TCS foods aren't.
If your product needs to live in a refrigerator to be safe — not merely to taste
fresh, but to be safe — treat it as a TCS food and assume it's commercial-only
until your state tells you otherwise.
The exact numbers are trickier than "4.6 and 0.85"
Here's the honesty most guides skip. "pH 4.6" and "water activity 0.85" are the
thresholds you'll hear quoted, and they're a fine mental model — but they aren't
a single magic pair you can hold your product against. The
FDA Food Code decides
TCS status with two interaction tables, and the cutoffs are stricter for the
foods a home kitchen actually makes.
For a food that's cooked and then sealed in a package, a pH of 4.6 or a water
activity of 0.92 is enough on its own to be non-TCS. But for a food that isn't
heat-treated, or is cooked and left unsealed — most home-kitchen products — the
stricter table applies: it's safe on its own only below about pH 4.2, or
below about 0.88 water activity. The reason is that pH 4.6 handles the
botulism risk the canning rules target, while an unsealed, uncooked food also has
to shut out hardier bacteria like Staphylococcus, which tolerate a little more
acid — so the stricter line sits lower. Anything between those values and the
food lands in a "product assessment" zone, meaning it's treated as a TCS food
until lab testing or a challenge study proves otherwise.
The practical takeaway: a clearly acidic pickle or a bone-dry spice blend is easy
to place. A borderline product — a low-sugar jam, a lightly-fermented sauce, a
moist quick bread — is not something you can eyeball or settle from a number you
read online. You measure it, and if it's near the line, you get a process
authority to assess it.
The states that now allow some TCS foods
For years the rule was simple: no TCS foods from a home kitchen, anywhere. That's
changing. A growing number of states have widened their laws to allow some
refrigerated or perishable homemade foods, usually with tighter strings attached.
Wyoming goes furthest. Under its Food Freedom Act (Wyoming Statutes 11-49-101 and
following), a home producer may sell even potentially hazardous foods — but the
law requires that a potentially hazardous homemade food be sold by "the producer
of the item," directly to the person who eats it. A non-hazardous food there can
pass through a third-party shop or grocery; a perishable one cannot — it has to
go straight from the maker to the consumer
(Wyoming Department of Agriculture,
verified July 2026). Other states have carved out narrower allowances for
specific refrigerated items.
The lesson isn't "move to Wyoming." It's that this list is genuinely
state-specific and changes almost every year, so the allowed and prohibited lists
you check have to be your own state's current ones — not a neighbor's, and not
last year's.
So — which side is your product on?
Put it together. If your product is acidic, dry, or otherwise shelf-stable, it
likely clears a hurdle and belongs on the cottage side, subject to your state's
specific list. If it needs refrigeration to stay safe, it's probably a TCS food,
and unless your state is one of the few that allows them, it's commercial-only.
Classifying honestly now saves you an ugly surprise later. If your product lands
on the TCS side, that isn't a dead end — it's a signal about when you'll need a
